Welcome to Sota. These terms and conditions define the rules and regulations for the use of the sota Website.

1. Scope

1.1. These conditions are agreed between SOTA – Carla Patrícia Cruz, with headquarters at Travessa do Galhalhás Nº 13, 1º Esquerdo - 2520 - 365 Peniche, hereinafter referred to as “SOTA” and between anyone wishing to make a purchase through the SOTA Online Store https: //www.facebook.com/364423620567402/app/519984624691308 or https://sota-shop.pt , hereinafter referred to as “User”.

1.2. Items displayed in the Online Store can only be delivered to Mainland Portugal and the Islands.

1.3. These conditions only apply to sales made to individuals who are not traders.

1.4. The parties agree that their relations will be governed exclusively by the general conditions described here.

1.5. The general sales conditions described here will be the only ones applicable between the parties.


2. Object

2.1. The purpose of these conditions is the purchase and sale contracts, concluded between SOTA and the User, from the time of ordering to the various services related to it and provided by SOTA, in particular the means of payment and the delivery conditions of the respective products.

2.2. These conditions also govern all the steps necessary to place an order and guarantee the monitoring of this transaction between the contracting parties.


3. Order

3.2. The order is only validated when all mandatory fields inserted in the “Customer Area” are filled in with the User's personal data.

3.3. When placing an order, the User expresses their full and complete acceptance of the general sales conditions, prices, description and technical specificities of the items mentioned in the transaction.

3.4. Orders are subject to availability of the respective items.

3.5. If an order for an unavailable item is validated, SOTA undertakes to inform the User and refund the amount paid for it within a maximum period of 30 (thirty) days from the date of knowledge of its unavailability.

4. Delivery

4.1. - Orders will be dispatched on the business day following payment, unless stock is out of stock or a defective item, and the customer will be informed immediately.

Given the war in Ukraine, CTT prices now include the fuel tax. This tax changes monthly.

Shipping costs are automatically calculated by CTT and their value is reflected in the order.

4.2. Orders can be delivered:

4.3.1. The order will be delivered to your home, at the address shown in our database. If you are absent, a postcard will be left with which you must pick up. (always keep your personal data up to date)

4.4. At another address

4.4.1. At an optional address indicated by the User in the “Customer Area”.

4.5. Until you receive your order, you can follow its status. To do this, click on the “Customer Area” and consult the “Order History”.

4.6. After your order has been dispatched, you will be sent an E-mail informing you of this.

4.7. In view of these conditions, delivery is considered to have occurred at the moment the User or any third party designated by them takes physical possession of the products, which will be proven by signing the record of receipt of the goods at the agreed address.

4.8. If the impossibility of delivering the items occurs due to a fact attributable to the User, only the amounts corresponding to the values of the items will be refunded.

5. Transmission of Risk and Ownership

5.1. The User acquires the right of ownership of the items as soon as full payment of all amounts relating to them has been made, including shipping costs.

5.2. Responsibility for the risk transfers from the moment the User or any third party designated by them takes physical possession of the products.

6. Payment

6.1. Payment can currently only be made via Multibanco (purchases worth €10 or more), bank transfer or Mbway.

6.2. If the chosen payment method is Bank Transfer, payment confirmation is subject to sending the respective proof of payment.

6.3. Payment either by Bank Transfer or ATM must be made within 24 hours. After this period, the order is cancelled. Mbway payment must be made within 5 minutes.

7. Pricing

7.1. Unless there is a mistake when presenting the online page, the prices of the items are as described in the Online Store https://www.facebook.com/364423620567402/app/519984624691308 or https://sota-shop.br .

7.2. The prices shown already include Tax on the Circulation of Goods and Services (ICMS),

7.3. After the invoice date, prices may be modified based on changes in the type of applicable VAT.

7.4. Prices and product specifications are subject to change without prior notice.

7.5. Sota declines any responsibility for any errors published in the Online Store https://www.facebook.com/364423620567402/app/519984624691308 or https://sota-shop.pt , resulting from technical anomalies.

7.6. As soon as any error is detected, the User is contacted immediately, in which case they can confirm or cancel the order.

7.7. If it is impossible to contact the User, the order will be canceled and the refund by bank transfer of any amounts paid, including shipping costs, will be made.

7.8. SOTA reserves the right not to supply any items at the incorrect price even if delivery has been confirmed.

8. Liability and Disclaimer

8.1. All item descriptions and technical specifications are provided "as is" without any express or implied warranties thereof other than those established by law. Indeed, if the User enters into a contract, we are obliged to provide items in accordance with the terms of the contract. In this sense, we are responsible to the User for any lack of conformity existing at the time of delivery. Items that comply with the contract are understood to be: (1) if they correspond to the description provided by us and have the characteristics presented in the Online Store, (2) they prove to have the normal quality for articles of the same type, and which can be expected from reasonable way. Under the law, all warranties are excluded, except those that cannot be legally excluded in favor of Users. Bearing in mind that these are handcrafted articles, it is natural that they preserve and highlight the characteristics of the natural fibers used. Therefore, characteristics such as variations in texture, knots and color cannot be considered defects. On the contrary, the User should expect their presence and enjoy them.

8.2. In view of the open nature of the Online Store, SOTA declines any responsibility for damages or virus attacks resulting from the use of the internet network.

Computerized records maintained in SOTA's computer systems under secure conditions constitute a means of proof of communications, orders and payments made between the parties.
